Terms of Service

These Terms of Service (“Terms”) govern your use of the TrackExpnz expense-tracking application and website (the “Service”).

1. Acceptance of These Terms

By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service. You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service.

2. What TrackExpnz Is (and Is Not)

TrackExpnz is a record-keeping and organization tool. It helps you record business expenses and mileage, scan receipts, and generate expense and tax-oriented reports. It is not tax, legal, accounting, or financial advice, and using it does not create an accountant-client or fiduciary relationship between you and TrackExpnz. Estimates the Service produces — including tax-savings figures, quarterly tax amounts, and deduction categorizations — are informational only and may contain errors or omissions. Consult a qualified tax professional before making tax or financial decisions. You are solely responsible for your tax filings and their accuracy, and we do not guarantee any particular tax outcome.

3. AI Features

Receipt scanning and automatic categorization use artificial intelligence. These features are assistive only and may produce inaccurate or incomplete results. You must review every extracted value — amounts, dates, merchants, and categories — before saving or relying on it. TrackExpnz does not guarantee that extraction is accurate or that any suggested categorization is correct for tax purposes.

4. Your Responsibilities

You agree to:

• Provide accurate account information and keep it up to date.
• Keep your login credentials secure and notify us promptly of any unauthorized use of your account.
• Verify all records in the Service against your source documents.
• Retain your original receipts and records as the IRS and other tax authorities require.
• Use the Service only for lawful purposes.

You are responsible for all activity under your account.

5. Subscriptions & Billing

TrackExpnz offers a free tier and a Premium subscription at $4.99/month or $49.99/year. Subscriptions renew automatically until canceled. You can cancel anytime: for web purchases, through the Stripe billing portal in Settings; for app-store purchases, through the applicable app store under its policies. Canceling stops future renewals, and you keep Premium access through the end of the current billing period.

Web purchases come with a 14-day money-back guarantee on your first purchase — email [email protected] within 14 days for a full refund. We will give you at least 30 days’ notice before any price change takes effect for you. Prices exclude taxes, which may be added where applicable.

6. Acceptable Use

Do not misuse the Service. You agree not to:

• Use it for any unlawful, fraudulent, or abusive purpose.
• Attempt to breach security or access other users’ accounts or data.
• Reverse engineer or attempt to extract source code, except as permitted by law.
• Scrape the Service or extract data at scale by automated means.
• Resell, sublicense, or commercially exploit the Service.
• Upload malicious or unlawful content.
• Circumvent free-tier limits, which we enforce.

We may suspend accounts that violate this section.

7. Your Data

You own the expense records, receipt images, and other content you submit. You can export your data at any time, including on the free tier, and delete it as described in the Privacy Policy. You grant us a limited license to store, process, and display your content solely to operate the Service for you (for example, generating reports and scanning receipts).

8. Disclaimer of Warranties

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that data extraction, categorizations, or reports will be accurate.

9. Limitation of Liability

To the maximum extent permitted by law, TrackExpnz and its officers, employees, and suppliers will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages — including tax penalties or interest, lost profits, or loss of data — arising from or related to your use of the Service, even if we have been advised of the possibility of such damages. Our total aggregate liability for all claims relating to the Service is capped at the greater of $50 or the amounts you paid TrackExpnz in the 12 months before the claim. Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so some of the above may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless TrackExpnz from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your records and content, your tax filings, or your violation of these Terms.

11. Dispute Resolution & Class Action Waiver

If you have a dispute with us, contact us first at [email protected] — most issues can be resolved informally, and we each agree to try in good faith for 30 days before starting a formal proceeding. If we cannot resolve it informally, the dispute will be resolved by binding individual arbitration under the American Arbitration Association’s Consumer Arbitration Rules, rather than in court — except that either party may bring an individual claim in small-claims court. YOU AND TRACKEXPNZ EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION; disputes may be brought only in an individual capacity. These Terms are governed by the laws of the United States and the state in which TrackExpnz operates, without regard to conflict-of-laws rules.

12. Termination

You may stop using the Service and delete your account at any time from Settings → Delete Account. We may suspend or terminate accounts that violate these Terms or use the Service in a way that could cause harm. Upon termination your right to use the Service ends; sections that by their nature should survive (including Sections 8–11) will survive.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or in the app before they take effect and update the date above. Continued use of the Service after changes take effect constitutes acceptance.
